On September 9, 2026, pursuant to Business and Professions Code section 7470.8(b)(1) & (2), PERB certified the California Gig Workers Union (CGWU) as the certified driver bargaining organization for a statewide unit of all transportation network company (TNC) drivers who drive for covered TNCs, based on evidence that at least 30 percent of active TNC drivers authorized CGWU to act as their bargaining representative. As the certified driver bargaining organization, CGWU now has the right to represent all TNC drivers in the unit and to bargain with covered TNCs over terms and conditions of work. Currently, Uber Technologies, Inc. and Lyft, Inc. are covered TNCs. Additional information about PERB’s administration of the TNC Act is available at https://perb.ca.gov/tnc-act/.
